Digital Artwork Download Terms of Use

Effective Date: August 14, 2026

These Terms of Use establish the conditions governing the purchase, download, and use of digital artwork files sold by Mukyokukan (“the Site”). Before placing an order, the purchaser must review and agree to these Terms.

Article 1 — Products Covered

  1. These Terms apply to digital download products sold through the Site.
  2. The products covered by these Terms consist of digital artwork files in JPEG or another stated format. Unless expressly stated on the applicable product page, no physical item, including canvas artwork, framed artwork, printed material, storage media, or certificate, will be shipped.
  3. If separate conditions are displayed for free wallpapers or other materials distributed without charge, those separate conditions will take precedence.

Article 2 — File Specifications

  1. The file format, image dimensions, resolution, color profile, and other specifications are displayed on each product page.
  2. Printing results may vary depending on the printer, paper, ink, color profile, printing company, and output environment.
  3. Before purchasing, the purchaser must confirm that the intended printing company, printing service, or output equipment supports the file format, image dimensions, resolution, and color profile of the purchased file.
  4. Images displayed on product pages are previews provided for viewing purposes. Colors may differ between the preview, purchased file, and resulting print due to the monitor, browser, device, and printing conditions.

Article 3 — Download Method and Availability Period

  1. After payment has been confirmed, the purchaser may download the purchased file from the order confirmation page or the order completion email. If the purchase was made using a customer account, the file may also be downloaded from the Downloads section of My Account.
  2. Each purchased file may be downloaded up to 5 times.
  3. The file will remain available for download for 300 days from the date of purchase.
  4. The download link will cease to function once the download limit has been reached or the availability period has expired.
  5. The purchaser must download the file within the availability period and is responsible for storing and backing it up in a secure location.
  6. We do not guarantee that the file will be made available again after the availability period has expired when the loss results from device failure, loss of a device, accidental deletion, failure to save the file, or another circumstance attributable to the purchaser.

Article 4 — Management of the Order Completion Email and Download Link

  1. The order completion email and download link are provided exclusively for use by the purchaser.
  2. The purchaser is responsible for keeping the order completion email and download link secure and must not forward, transfer, share, publish, or otherwise make them available to any third party.
  3. A third party who obtains the download link may be able to download the file without being identified as the purchaser. Any download made by a third party will count toward the purchaser’s download limit.
  4. Except where caused by intentional misconduct or gross negligence on the part of the Site, the Site will not be responsible for unauthorized use resulting from the purchaser’s failure to protect the email or link, accidental transmission, forwarding, sharing, unauthorized access to the purchaser’s device or email account, or another circumstance attributable to the purchaser.
  5. If the purchaser suspects that the download link has been disclosed or used without authorization, the purchaser must contact the Site promptly.
  6. After verifying the purchase record using the order number, purchaser’s name, email address used for the purchase, or other necessary information, the Site may revoke or reset the existing download permission or take other appropriate action.
  7. We do not guarantee that download permission will be reset or that used download attempts will be restored when disclosure, loss, or use of the link results from circumstances attributable to the purchaser.

Article 5 — Proof of Purchase

  1. No individual edition number or separate certificate will be issued for the artwork.
  2. The purchase date and order number serve as unique identifiers for the purchase record, and the order completion email sent by the Site serves as proof of purchase.
  3. The purchaser must keep the order completion email, together with the download information, in a safe place.
  4. The order number identifies the purchase record. It does not establish a transfer of copyright, a limited edition, or exclusive ownership of the artwork.

Article 6 — License

  1. The Site grants the purchaser a non-exclusive, non-transferable, and non-sublicensable license to view the purchased digital artwork for personal and non-commercial purposes.
  2. For personal and non-commercial viewing, the purchaser may produce a reasonable number of fine-art prints and display them in the purchaser’s home, personal workspace, or another private space.
  3. The license granted under this Article does not transfer copyright or any other intellectual property right to the purchaser.
  4. If a product page expressly states separate conditions that differ from these Terms, those separate conditions will take precedence for that product.

Article 7 — Prohibited Uses

The purchaser must not engage in any of the following activities:

  1. Selling, reselling, redistributing, renting, transferring, sharing, or otherwise providing the purchased file or any reproduction of it to a third party
  2. Uploading or posting the purchased file to a website, social media platform, online storage service, file-sharing service, or any other location accessible to the public or a third party
  3. Using the purchased file or a resulting print for commercial purposes, including in products, advertising, publications, videos, websites, interior design services, or similar activities
  4. Producing prints for sale or distribution to a third party
  5. Registering or providing the purchased file as part of a resource collection, template, stock image library, or other source material
  6. Issuing, registering, or selling the purchased file or any derivative work as an NFT or other token
  7. Using the purchased file for the training, fine-tuning, evaluation, dataset creation, or input material of an AI model, machine-learning model, generative AI system, or other automated processing system
  8. Removing, altering, or falsifying the artist’s name, Content Credentials, rights information, provenance information, or authentication information for the purpose of infringing rights, misrepresenting the source, or engaging in another improper activity
  9. Using the purchased file in a manner that damages the reputation of the artist or the Site, violates public order or morality, or violates applicable law
  10. Allowing a third party to use the purchased file in any manner not permitted by these Terms

Article 8 — Content Credentials

  1. A purchased file identified on its product page as including Content Credentials contains Content Credentials that may include information concerning the artist, creation and provenance, rights, and the intended conditions of use.
  2. Content Credentials may be lost in whole or in part when a file is resaved, converted, edited, compressed, printed, captured in a screenshot, uploaded, or processed by software or services that do not preserve such information.
  3. The loss of Content Credentials does not terminate or modify the copyright or the conditions of use established by these Terms.
  4. The purchaser must not intentionally remove, alter, or falsify Content Credentials or other rights information for the purpose of infringing rights, misrepresenting the artist or source, or engaging in another improper activity.

Article 9 — Copyright and Intellectual Property Rights

  1. Copyright and other intellectual property rights in the purchased files, artworks, product images, descriptions, and other related content belong to the artist, Masaki Wakabayashi, or another lawful rights holder.
  2. The product price is consideration for the limited license granted under Article 6. Copyright and other intellectual property rights are not transferred to the purchaser.
  3. The purchaser must not falsely identify the artist or represent that the purchaser or another third party created the artwork.

Article 10 — Returns, Exchanges, and Cancellations

  1. Due to the nature of digital products, we do not accept returns, exchanges, or cancellations for reasons attributable to the customer after an order has been confirmed.
  2. We do not accept returns or issue refunds due to insufficient pre-purchase verification, unsupported software or printing environments, differences between monitor and printed colors, printing results produced by a printing company, or other circumstances attributable to the purchaser.
  3. If the purchased file is corrupted, the wrong file has been provided, the file clearly differs from the specifications stated on the product page, or the file was not properly provided due to circumstances attributable to the Site, please contact us and include the order number and details of the problem.
  4. After reviewing the circumstances described in the preceding paragraph, the Site will provide an intact file, restore download permission, or take another appropriate measure.
  5. Nothing in this Article is intended to improperly restrict any rights available to the purchaser under applicable law.

Article 11 — Technical Problems

  1. If the file cannot be downloaded normally due to a communication failure, browser problem, or another technical reason, please contact us and provide the order number, device, browser, and details of the problem.
  2. Based on the order information and available records, the Site may restore download permission or take another appropriate measure when necessary.
  3. The purchaser is responsible for internet access charges, communication charges, printing expenses, storage media, software, and other costs associated with using the purchased file.

Article 12 — Disclaimer

  1. The Site does not guarantee that the purchased file will be compatible with a particular printer, software application, printing company, or intended use of the purchaser.
  2. The Site will make reasonable efforts to provide accurate product information and functioning files. Except where exclusion of liability is not permitted by law, the Site will not be responsible for damage resulting from the purchaser’s environment or other circumstances attributable to the purchaser.
  3. Any provision that excludes or limits the liability of the Site applies only to the extent permitted by applicable law.

Article 13 — Changes to These Terms

  1. The Site may amend these Terms when necessary due to changes in law, changes to the services, or other circumstances.
  2. Amended Terms will take effect when posted on the Site or on another effective date expressly stated by the Site.
  3. Unless otherwise required by law or expressly provided in these Terms, the conditions displayed at the time of purchase will serve as the basis for determining the conditions applicable to a product already purchased.

Article 14 — Governing Law

These Terms are governed by the laws of Japan. If a dispute concerning these Terms arises, the Site and the purchaser will first attempt to resolve it through good-faith consultation. If no resolution can be reached, the matter will be handled in accordance with applicable law.
